When are foriegn convictions considered "spent"

Post by yankeebrit » Tue Oct 02, 2012 5:02 pm

Does anyone know when foreign convictions are considered "spent" by the UKBA.

My wife has a USA misdemeanor for which she received 3 years probation. Would that be spent in 5 years from the date of conviction? Or is it more complicated than that?

Many thanks!

From reading that it sounds as though a conviction that was passed down by a foreign court will be handled in the same way as if that conviction had happened in the UK...I.e a probationary sentence with no prison time will be spent after 5 years...

I have been told by other sources that the UKBA take the MAXIMUM sentence of the EQUIVALENT conviction...I'm not sure that this is the case...
