ILR via partner Visa

Post by Poodie » Wed Oct 03, 2012 9:44 am

Dear All,
My girlfriend/unmarried partner and I have been living together in the UK for 5 years. 2 years ago, while I was on an ancestral visa, she was able to join me on my visa as an unmarried partner. I have since become a british citizen, which means that during those 2 years my status changed from ancestral visa, to ILR, to British citizen. During this time we made no changes to my partners visa. My question is, after 2 years on a partner visa, is she elligible for ILR? Would me becoming a british citizen during that period affect anything?

Any help would be appreciated. I do not want to make the application and waste several hundred pounds.

Thanks

It is not clear what immigration status your partner currently has.

You say:

BUt I don't see any provision in the immigration rules to allow unmarried partner of a person in UK under ancestory to be granted entry clearance (194) or leave to remain (196A.
Life isn't fair, but you can be!

That seems odd, I know several people who have achieved entry clearance on their partner's Ancestral visa. The partner is simply granted a visa with the same status as the person with the ancestral visa, provided you can demonstrated you've been living together for 2 years.

Anyway, I'll be the first to admit that I don't know too much about this, its why I asked!
