Travelling outside UK with EEA1?

Hi, my husband recently entered the UK on an EEA1. We are now getting ready to apply for his RC via EEA2 however I am aware that it will mostly likely mean he will be without his passport for 6 months. I am from Ireland and we were hoping to go there for Christmas. Is it possible for him to travel to Ireland on with his EEA1 and then we could apply for his EEA2 on our return or will there be problems for him re-entering the UK?

I presume your husband has a EEA Family Permit and not EEA1 (which is for EEA nationals).

Thanks for the quick response! Sorry, yes my husband has entered UK on an EEA family permit. I read the link you posted which suggests to me that he can leave and return to the UK. Am I correct? Apologies if I am asking you to overstate things. I just want to make sure we get things right!

He should have no problem re-entering the UK.

Depending on his nationality and how you travel, he might need a visa to enter Ireland or the airline would not allow him to board a flight (assuming you are flying to ROI).

Thanks Jambo. We will be travelling to ROI - I think he will need a visa for there. It's next on my list of things to sort out.I just wanted to make sure he could leave and re-enter UK first. My husband is Cuban. Do you think his nationality will pose a problem for re-entry? Not sure how we will travel yet. We may fly or maybe get the ferry. Is there any additional documentation we should bring other than our passports his visa for entering ROI and our marriage cert (he was asked for this on entering UK)?

I was asking about his nationality for the visa requirements for Ireland. The EEA FP will cover the UK part.

Free movement directive allows visa free travel to family member traveling together with the EEA national as long as they prove the relationship (marriage certificate). The issue with airlines is that they won't allow boarding without a visa as they can face a fine if a passenger is refused entry. If you present yourself at the border with a marriage certificate (and proof of you working in the UK), he will allowed to enter.

I'm not familiar with ferry travel to Ireland so I have no idea if you can get to Ireland and present yourself in front of the immigration officer without being stopped before.
