Claiming benefits - ILR holder and Unmarried Visa Partner

Post by sanjayrocks » Fri Oct 05, 2012 8:36 am

Hi,

My friend(female) is on ILR and she is eligible to apply for the British Citizenship after May 2013. Her partner is on Unmarried Partner Visa and he is eligible to apply for ILR by March 2013.

She is pregnant 2 months and earlier she had to quit the job for some reason. She was working as a Manager in a restaurant and receiving around
£20,000 per month.

Her partner is receiving around £14,000 pa and currently looking for a 2nd Job since the lady has no job. They are sharing a house with some friends right now.

1) Can she apply for any sort of benefit(Maternity pay)? - At least to cover her share of rent.
She is not in a position to work due to her condition even she is in her early pregnancy stage.

2) If she get some sort of benefit will that affect her Citizenship application and her partners ILR application which are due next year? (Reason not financially stable)

3) Can they visit the Citizen Advice Bureau and get some help/advice ?

Many Thanks

She can't claim public funds (as defined). Not all benefits and allowances are classed as public funds. Her partner may claim whatever he feels he is entitled to. Anyone is permitted to visit at CAB (during opening hours).

Hi,

Thanks for the quick response.

1) If she has ILR isnt she entitled to public funds? What do you mean by she cant claim public funds? Is it because she will get issues when applying for British Citizenship

2) Her partner is in Unmarried Partner Visa. Can he claim any benefits ? I thought to claim benefit someone needs to get ILR at least.

Thanks

He rather than her! Perhaps it would be better to have the subject of the discussion ask her own questions. My misinterpretation of your third party hearsay is not the best way forward.
