Sponsorship Undertaking form for spouse visa

Post by olawest » Fri Oct 05, 2012 12:04 pm

Is the Sponsorship Undertaking form in this link a mandatory requirement for spouse visa?

http://www.ukba.homeoffice.gov.uk/sitec ... p-form.pdf

What are the implications of signing the undertaking?

Will this undertaking form compensate for the maintenance and accommodation requirements?

Hello Luca:

Why do you think some ECO in some countries have made the 'Sponsorship Undertaking Form' mandatory for spouse visa sponsors. They dont accept your applications until the sponsor complete and sign the form,

I don't think they have because I know that they haven't. Can you indicate one case where an ECO has asked for this document with regard to a partner application, and refused an application because of its absence? I don't believe that you could!

It's required only for an elderly and/or dependant relative application and this is clearly indicated in the ECGs.
As with undertakings from an applicant (see above), the ECO should only require an undertaking from a sponsor in exceptional circumstances or for certain categories eg parents, grandparents and other dependent relatives under Rule 317 of the Immigration Rules
I think some VACs (VFS in some locations, therefore not the UKBA) have taken it upon themselves to include and even request this document on the list of supporting documents for a settlement application but without bothering to explain that it not necessary for every category of settlement application. They are just being lazy with the presentation and inconveniencing people with their incompetence.

Hi Luca:

I agree with your point. Some VFS centers dont accept your application until a spouse visa sponsor signs the undertaking. I am surprised people are been forced to make this undertaking despite the new rules on financial requirement.
