Financial requirement.

Post by ahhong » Fri Oct 05, 2012 2:53 pm

Hi,

New on the board so 'Hi' to anyone who is reading and would help answering my questions.

Just a brief background. I am a UK citizen, i was born in the UK but have left the country after my education and have since been working abroad for almost 7 years.

Me and my wife (not British) have been married for two years and i now hope to move back to the UK and start a family.

My question is regarding the income of £18,600. Obviously, if i decide to return to the UK i would quit my current job here. So does that mean i should have a job in place back in the UK in which i will be earning at least £18,600 before i can bring my wife to the UK along with all the other rules that are in place?

Yes. Or you can have savings of 62,500; or you can have a job offer at at lower salary and make up the shortfall with savings.

Thanks for the quick reply Lucapooka.

I understand why the UK government have introduced this law but it really does make my plan of returning to the UK so much harder.

The UK economy isn't great as it is so i don't expect finding a job there is going to be easy at all and the savings of 62,500! That is just too much.

I never thought marrying a non British would hurt my plans to return to the UK with my partner, even though i am British!

In a nutshell and without any prejudice intended:

The UK has no problem with you marrying a person who would, otherwise, have no residence rights in the UK; nor does it have any objection to you returning to live in the UK with your non-EU partner. However, the UK would not wish your family to be a financial burden on the public purse (it does not seek to import poverty, so to speak) and these are the measures that it has put in place to prevent that.

Child

Post by ahhong » Fri Oct 05, 2012 3:23 pm

If me and my wife had a child outside of UK would the child be classed as a British as i (father) am of British nationality?

Would we have to pay for the child's education because he/she is not born in the UK?

Since you are British by birth, you child born outside UK will be British by descent.
Life isn't fair, but you can be!

I think this hi-lights your lack of research into the relocation of your family. Take time to read the information on the UKBA site before you proceed with any applications.

Thanks for the replies.

Yes, i don't have much knowledge with any of this because its only recently that me and my partner is talking about these issues. And we kinda want some quick answers and clarifications.

Thanks again for taking time to reply, much appreciated.
