My ILR was approved.I am just waiting for my BRP as I am writing this letter.I have a daughter overseas.Her tier 2 dependent visa was refused so I couldnt bring her with me when I returned to UK.I have visited her in April and now I want her back with me as soon as possible.i cant apply for her ILR, as my husband is not here.
he was here illegal, went back voluntarily on own expense.we got married, i fell pregnant, and we applied for his tier 2 dependent visa before the 12 month ban was lifted.it was refused.then we applied after the 12 month ban was lifted, and after baby was born.it was refused because i didnt visit him during the time i was pregnant, and i didnt go to see him after baby was born.So, they said, our marriage was not real.
His visa was not refused under paragraph 320.11. He was never ordered to leave, or deported, and he never commited any crime.He lived and worked illegally.We believed that if he leaves,he will be able regularize his stay in UK.It didnt work, and here we are, 2 years later...
We travelled to my country(My husband is from Albania and I from South Africa) so he could meet our baby, and then I applied for my baby's dependecy visa.It was refused because my husband doesnt have permission to be in UK.
So, I can't apply for my daughter's ILR, it will be refused for exactly the same reasons as before.Should I apply for a child visitors visa for her instead?
I will apply for my husband's spouse visa, but we thought it is best to have our daughter back in UK first, and then we(my daughter and I) go and visit him in his country a couple of times before we apply for his spouse visa.
So my question, do I stand a chance of getting my daughter back in UK on a child visitors visa, or should I apply for my husband's spouse visa first,hoping it will be successful as we have been together twice in 2011 and 2012, or should I apply for daughter's british citizenship as she was born in UK?Sorry about rambling on and on, i thought it is best to explain the complicated situation as clear as possible, and hopefully, I get a few suggestions from senior members and moderators.
