Schengen Visa Stay Duration (France)

Post by aditya.gangwar » Sun Oct 07, 2012 5:26 pm

Hi -

I have a Schengen Visa (Type C, Multi entry) valid from '01-09-2012 to 01-11-2012' with 'Duration of Stay=30 days'.

I have an Indian passport.

I have already stayed in Paris from '02-09-2012 to 29-09-2012' and came back again on '02-10-2012', and planning to stay till '31-10-2012'.

While entering Paris on 02 Oct, the Immigration guy initially said that I can stay only 4 days, as I have already exhausted 26 days (of 30 days duration) in my pervious visit.
However, on my insistance he asked for my return ticket (which is of 31st Oct, 2012) and spoke to some guy over the call and then said to me, it is Ok you can stay till time as per your return ticket (31st Oct, 12).

However, since I was still doubtful, so today (07th Oct, 12) I once again went to the Airport and met the 'Police personnel' there, to discuss on my Visa.
Again, initially they maintained that I cannot stay more than 30 days, but when I told them, that 1) I need really to be here til 31st Oct and 2) its hard to get my ticket changed and that 3) while entering itself the immigration guy confirmed me that I can stay till 31st. Then he said, Ok you can Stay, not an issue, just make sure you do not cross the Visa validity dates (i.e. return on or before 31st Oct, 12).
I asked him 2-3 times after that, and he said - do not worry, you can stay, and atmost while leaving if they ask then you can show company docs for your purpose here etc.

So, basically both times, while entering Paris and again, they told me that you can stay and it won't be any issue, but only after my insistance.

Now, I have few questions -

1) Do you think, it is safe for me to Stay till 31st Oct, 12, and while leaving they wont bother me, specially since twice they have confirmed me on this?
2) While leaving on 31st Oct, in case they do not agree with me, what possibly they can do to me - like fine me or do some stamping on my passsport as 'illegal' etc?
3) How you think, I can best defend my stay till 31st and explain them that I stayed only after assurances from them, twice.

'Duration of Stay' means exactly what it says. You may have your next visa refused or maybe even a re-entry ban is possible. I would not rely on oral advice.
