Hi,

I am stuck in a unusual situation. Back in 2010 October i had applied for a PSW visa whilst i still had a valid student visa. But it took long for them to decide and they refused it after my visa ran out. So i appealed the decision and at the same time applied for FLR (M).

{I could not apply for FLR M in October as my wife was still not 21 as per then rules..}

Now the PSW appeal got refused again in March, but decision of FLR M was still pending. Just 2 days ago I have received my FLR M application back saying while I had an appeal pending according to Section 3C of Immigration Act my application was invalid.

Now the current situation is I havnt got any valid visa (expired Oct 2010) and they havnt told as to how many days I have to leave the country ?? Please can anyone advise me on that ??

Also I had seen a solicitor and he said i could apply FLR O now asking for some time to wind up things before I leave..

But I have a few questions
Firstly how long does it take for FLR O decision ??
Secondly how many days I have now if I dont apply FLR O ??
Thirdly if I get FLR O can I within that time make a fresh FLR M application ??



If anyone is or knows somebody in a similiar situation can you answer my queries please ??
Any help is much appreciated..

You mention an FLR(M) application but fail to elaborate. Do you have a settled partner living in the UK?

yes my wife is born and brought up in uk and she is settled here.. and we live togather since about a year now..

Apply for entry clearance from outside the UK as spouse of a settled person.
Your overstay in the UK (since March till the day you leave UK) will have no affect on your spouse visa application (A320).

Can i apply for FLR O while am here and apply FLR M while I am on FLR O ???

On what grounds do you wish to apply for FLR(O)?
Statement of intent - family migration wrote:A person who does not meet the requirements of the Immigration Rules will no longer be considered for Discretionary Leave outside the rules on Article 8 grounds.
FLR(M) application requires applicant to be in UK on valid leave.

I was thinking 'Other reasons not covered by other form' and ask to give some time so as to wind up things before I leave. I live here for about 4 years need to sort things out such as credit cards, bank accounts, current work cimmitments etc. (thats what a solicitor said)

You will not be granted leave on the basis of those reasons.
