UK Tier 2 (Employer Sponsored) visas - Query regarding Coold

Post by MKG004 » Wed Oct 10, 2012 7:33 am

Hi,

I got my VISA issued on 22nd June 2011 and it was valid from 27-Jun-2011 to 26-Jun-2012.

I entered UK on 3rd October 2011 and returned back on 28th January 2012. I did not return afterwards.

Am I eligible for a fresh Visa in the same category? Or would I have to wait till July 2012 to apply for a fresh VISA?

Thanks.

I forgot to mention, my VISA was ICT tier 2 for short term.

In the T2 ICT Long Term Staff category you could apply for entry clearance at any time (no cooling-off).

However, if you wish to apply again in the T2 ICT Short Term Staff category you would need to wait for 12 month from either 26/06/2012 or the cancellation of your previous T2 leave whichever the earlier.

Check whether after you left the UK in January 2012 your leave has been curtailed. This should have happened if your employer had reported your departure.

Thanks for the quick reply, manci!

I have to apply in the T2 ICT Short Term Staff category only.

How do we check if my leaves were curtailed?

in the first instance ask your sponsor if they reported your departure to UKBA.

Even if they did, UKBA would take about a month to decide to curtail your visa to 60 days from the date of their decision, so with this scenario your leave would have been curtailed to some time in May 2012 which is just a little over a month short of the expiry date of the original leave you had.
