ILR for myself first and then for wife

Post by ana.sssn » Wed Oct 10, 2012 10:34 am

ASAK,
My ILR is due on end of Jan 2013.
I have a daughter who is born a year ago in the UK and expecting a new child during 2nd week of January.
I am planning to approach during early 2nd week of January for PEO.

Question:
Is it recommended to first apply ILR for yourself and then apply for wife ?
We have no plans to travel out of the country for atleast next couple of years.

Kindly advise.

1. If possible, and if your circumstances allow, try to get your ILR before your second child is born.

2. What is your / wife's current visa expiration? How long has she been here as your dependent in her visa? How long has she been here with you (not necessarily as your dependent in visa)?
Please do not send me PM if I haven't sent you one yet.

OCI for children

Post by ana.sssn » Wed Oct 10, 2012 1:36 pm

Yes, I am planning to apply before the birth of my second child.
My wife is my dependant and her visa is set to expire as per mine.
She already completed 2 yr with me. I do have all cohabitation documents for past 2 years in place.

Since my first child was born in UK a year ago, Can i just apply for ILR for me and my wife at PEO. I already got Indian passport for my daughter and registered her birth with the Indian Consulate General. I am further planning to apply british passport for my two children and thereafter apply for OCI(Overseas Citizen of India) permit for my children on their british passport along with me. Please advise on this.

If your wife is applying with you as your dependent, then you would need to consider her health/wellbeing and logistics as well, IMO. So selecting the right PEO with not very long queues would be ideal.

Please advise on this. There probably is a different forum for OCI part of your question..

ILR application

Post by ana.sssn » Wed Oct 10, 2012 11:17 pm

Hello,
I landed in UK with HSMP.
Worked for 9 months for an employer and then started business.
Got my first extension based on employment and self-employment for Tier1. After that for next 2.5 years I was just self employed making a basic earning of around 10k per annum.
I was prompt paying tax returns to the HMRC.
I have all my FA302 used for self-employment from HMRC (replacement for P60) for past 4 years. More or less, my earning through self-employment was around £10k. I gave up focussing on business and upskilled myself and got a 30 K job 15 months ago.
I am still registered as a self employed with HMRC and also does run the business as part-time.
I now need to apply for ILR. My present employment is sufficient for proving earning score.?
If I consider my last 12 months payslip and bank statments, letter from employer, I am scoring 85 points as per the ILR parameters.
I have all the other related documents in place.

Is my self employment for 2.5 years considered
Please advise.
