Hi,

If the Main applicant is UK on T1G. He apply for settlement with his family. Due to any reason, stay/LIUK/Criminality the settlement for spouse is refused. Can she apply for extension of stay? If yes, please advise;

1. Which form to use?
2. How early can she apply for extension of stay after getting the refusal letter?
3. If the time between ILR refusal and applying for extension is more than 7 days and less than 28 days, does this count as over staying OR breaking the continous residence requirment?
The question is... to be or not to be....

1. Applications by dependants.
2. Within 28 days of becoming an overstayer.
3. If there is a right of appeal, then an application for extension within the time period stipulated for submitting an appeal will not break continuous residence. If right of appeal is not given or if extension application is not submitted within the time period outlined above then continuous residence will be broken.
