Tier 1 5 yrs completed + 10 yrs legal stayed in UK

Hi expert
My ten (10) years legal stay in UK will be completed just 15 days before my five years coplete stay in tier 1 general category. I am thinking to apply in 10 years category but problem is my wife and one kid will be overstayer in this case due to they can't apply with me in this category of application.
(1). My question is can they apply with me for ILR? If it is how they can??

The reply will be highly appreciated.

1. When is your and your dependants' current leave due to expire?
2. Do you meet the requirements for settlement as a Tier 1 (General) migrant?

Answer: [1]. Our current leave will be expire 14th July'2013 and my ten years will be completed two weeks before then.
[2]. Yes I do meet all the requirements for settlements as a tier 1 general migrant.

In such case my suggestion would be that you apply for settlement under PBS route as a Tier 1 (General) migrant rather than under long residence. This way, you'll be able to include your wife in your settlement application as a dependant.
