My Husband applied for ILR but hasnt got his passort back

Post by woteva25 » Sat Oct 13, 2012 1:36 am

I am a British national and My Husband applied for leave to remain in uk last year in april, in december we got a letter saying the case has been refused therefore we appealed the case.

In january 2012 we attended the appeal at the tribunal service at Manchester, the appeal was granted straightaway and we were advised that we would get his passport within 28 days.

Its been nearly ten months since we have not received anything back from the UKBA, I have contacted them on various account, whenever i ring them they are very rude and advise me to wait, our solicitor has contacted them on various account to and he is getting the same response that we should just wait.

i was also told to write a letter to UKBA which i did and i have not got a reply. My local MP has also written to UKBA but he has not got any response

My husband needs his passport so that he can visit his sick parents.

hope you can help and advise

Is your legal rep actually a solicitor or just an immigration advisor? A letter before claim would sort this out (this is letter threatening to apply for judicial review)

What are they saying to him?Wait for how much longer?Has he written a letter threatening UKBA with judicial review?

Has your husband been given status or just his passport is being held? His passport is likely being held at your local UKBA enforcement team.Phone them them up and ask them to implement the appeal if the hasn't been given status or ask for his passport.

Don't call the 0870 number they are just a call center the numbers to call are here http://immigrationboards.com/viewtopic.php?t=86090.

Some mps are not sympathetic to the plight of immigrants i just hope your mp is not conservative.UKBA have a dedicated team to answer ALL inquiries from mps

Phone the local center nearest to your home.Have your husband home office reference number ready. If you still have the refusal decision phone the number on the decision or fax them the judges determination and ask them to implement the appeal

To find more about judicial review go http://immigrationboards.com/viewtopic.php?t=38426 http://www.judiciary.gov.uk/you-and-the ... ial-review

If your solicitor is not helping you go to your local law center http://www.lawcentres.org.uk/ most of them offer free immigration advice.

The call center have no clue........all UKBA has to to do is to implement the appeal not to ask you if you want to withdraw the application the one that they have already refused .

Once they get the letter from the law center they will act quickly.
