Hi,

I am currently in tier 1 visa (general) and my visa is expiring on Feb 2013. I am not getting enough points (85 points instead of 100 points) to extend my Tier 1 visa. I am planning to switch from Tier 1 to Tier 2 visa.

I am planning to apply ILR after three years. I would like to know is there any issue will occur while applying ILR?

I have gone through the SET O form. In that, it has mentioned that I need to complete 9A section details (Tier 1) along with Tier 2 details.

SET O Form:
11P: Tier 2 migrant If you are applying for indefinite leave to remain in the UK on completing 5 years’ continuous stay in the UK and your most recent leave has been as a Tier 2 migrant, the rest of your leave for the 5-year period may be made up of leave in any of the categories listed below. In addition to the relevant documents in 11A, you must provide the following specified documents:
For the period before you were granted leave as a Tier 2 migrant, documents showing that you met the relevant requirements of the immigration rules for the period in question as specified below:
If you were a Tier 1 (General) migrant, evidence that you were economically active in the UK in employment or self-employment or both (see section 11L)
11L:
Tier 1 (General) migrant If you are applying for indefinite leave to remain on completing 5 years’ continuous stay in the UK made up of leave as a Tier 1 (General) migrant and leave as a highly skilled migrant, work permit holder, innovator, self-employed lawyer or writer, composer or artist, in addition to the relevant documents in 11A, you must provide the following documents:
Evidence specified in section 9A of this form
9 A1. You can claim points for previous earnings for any single, consecutive 12 month period from the 15 months immediately before this application. The only exception to this is where you have taken a period of maternity or adoption-related absence.

If I need to fill the details then I won't be getting 100 points. Please let me know do I need to enter the tier 1 details or my P60 will be sufficient (2011 to 2012). Also please note that I can claim the previous earnings only 15 months immediately before the application.

I would be very grateful and obliged senior members of the board clarify my doubts.

11L has no relation to you whatsoever - as you'll be applying as Tier 2.
In addition to documents required of Tier 2 you'll need to show that you were economically active while on Tier 1, i.e. provide any two of P60 / payslips/ bank statements.
