Dear moderators and Members

I have gone through some of the previous posts in this forum and I feel this should be possibe if both the visa's are granted as Leave to Enter outside UK.

However my Situation is as below

1. I entered UK with a Tier 2 ICT short term Visa.
2. In July 2012 converted to FLR (M) within UK ( My husband holds an ILR) to avoid the 5 year rule for settlement
3. Now that my Short term ICT visa will be coming to an end by Dec , My employer wants me to go back and they plan to process my Tier 2 ICT long term visa.
4. I guess I can continue working for them here without having to leave UK as I hold a FLR M
5. However this would mean i have to work for the same salary on which I entered UK which will be atleast 5000 GBP/year less than what I would get if I come back on Long term ICT Tier 2.
6. For the above reason I am planning to go back and get my Tier 2 Long term ICT processed and come back
7. My worry is that if I do so will my FLR (M) be active still as I dont want to get into the 5 year rule again for ILR

A successful Tier 2 entry clearance application will invalidate your FLR(M) leave.

Anyhow Thanks a lot for your clarification .. I think I will sacrifice the additional salary for my ILR status

Is the employer aware that you have already changed your immigration status to that of a spouse of a settled person? Have you tried to negotiate a pay rise on your current status?

Yes my employer is aware of my current visa status and yes I have discussed about the pay rise and my manager's initial reaction was that he can't guarantee a revision with FLR(M) visa but he insisted it is possible with a long term tier 2 ICT visa as there are minimum salary criteria thathas to be met with those visas .

That's why I was exploring that option .

However I will now go back and get it checked with the HR and the immigration guys in my company ..

It seems to me to be discriminatory to offer different pay levels according to immigration status.
