Registration+Residence card

Post by arielyeh » Mon Oct 15, 2012 7:37 pm

Hi,
I'm a non-EEA married to an EEA national, we just moved to the UK recently and my husband hasn't apply for a registration certificate yet.
I'm now ready to apply for residence card, will we be able to sent our documents together and apply both at the same time? Or I'll have to wait until he's registered.
Thank you for your help!

If you have got the sufficient documentation regarding the excercise of EU treaty of EEA partner then any time you can apply EEA2 + EEA1 (Registration certificate/card). One set of documents will work for both applications.

Thank you for your reply.
Another concern of mine is the decision time, I heard it can take up to 6 month, which my current marriage visitor visa will be expired for sure, does it means I won't be able to travel until I get the residence?
Will there be any problems later on if I haven't leave the country before my visa expires?

Yes EEA2 application takes up to 6 months and sometimes even longer. After submitting EEA2 application you can request for your passport back and under EEA law it does not matter that your visa is expiring as long as your EEA partner must be excercising its eu treaty rights. You can travel and on your arrival you can produce marriage certificate and some clarification/proofs of your EEA partner excercising its eu treaty rights in uk.

Meaning I have to have all the supporting documents with me whenever I travel? Or is there a proof of application in process?
Thanks.

On your arrival back you can verbally explain your situation but if you have some of the copies of evidences handy then it will be much easier/quicker for you.
