EEA2 application to send tomorrow

Hi,

I recently got married to EEA family member and I am applying for a residence card with in the next 2 days and I need help.

I came here on 2 years spouse visa with my ex british wife which will be expired end of november.. However I got dovorce as we got married back home so she didn't have to be there and I got married to my EEA parter and we have british marriage certificate.

I am already working full time for the 2 years and she is working part time.

Do I have also to send my ( last pay slips, letter from work, and P46, bank statment and council tax.. And my saving in my. UK bank account ?

As support of my application? We been living together since February 2012 and I have tennancy agrememnt and council tax with both names on and same address for bank statments and pay slips..

Any advice .. Thank you in advance :)

I suggest you read the application form. If the EEA national is working, the activities of the non EEA national are irrelevant. You just need to provide your passport (and documents to prove your wife is exercising treaty rights).

Thanks for your reply .... i am paying for the rent and i am helping her out with living and its written on the application if she receiving any help or support from any resources i should prove how? so if i let them know because i am full time and have saving etc.... that wont help?

There are several ways to exercise treaty rights. The two that seem relevant to your wife are employment and self-sufficient (living off savings). However, being self sufficient require both of you to have CSI (private health insurance).

It would be a much simpler application if it is based solely on your wife work and doesn't involve any saving or being based on your work (unless she works just 1-2 hours a week which might be a problem. But anything above 10 hours a week should not be an issue).

shes working 10 hours a week and for over 3 months now and we will send
1- letter from her work with the start date.

2- last 3 months pay slips and also her employer signed and stamped the EEA2 application on Employment section.

we dont have any health insurance i am afraid but i have insurance with lloyds bank.

so how is that sound?
do i need to write covering letter explains the whole situation?

If your EEA partner is working then you do not need any health insurance at all because its only for students/self sufficient cases. In now a days COA is taking 1-3 months, however there is an employer helpline to verify the employee right of work and you can tell your employer about that too.

Thanks for your advise.. i am sending my application now..

so even while i am waiting for my COA i can tell my employer about employer help line and i can keep working? and whats the number for it?

you suggest i send actual pictures or CD?

i am sending a covering letter explaining how my ex was bad to me and how i met my partner and for how ling we been living together etc!!

is it good to be honest or that dont work with HO :)?

There is no requirement for sending wedding pictures/cd and it is totally optional but sending covering letter is a good idea. But try to make it precise & relevant.

I have put only 2 pictures and CD if they want to see more pictures..

The thing is they might say its marriage of convenice as I came on UK spouse visa divorced and married to EEA.. And I think I might be one of few who managed to do or in the same sitiuation..

That was my letter ..

To whom it may concern,

I am writing to apply for a residence card as EEA family member.

I came to the UK on spouse visa ( with my ex British wife ) and i had to leave my job and family back in Egypt and moved to the UK.

I tried to resolve my marriage but it didn't work and we seprated .. found a good job and I couldn't go back to Egypt as we had the Egyptian Revolution and it was not safe to be there.

I met my recent wife on September 2011 and we been seeing each other till we moved together on February 2012 and we have a really happy life together and i found my self with her. i told her about my 

ex wife as i always think Honesty is the best thing to say. she didn't like the fact we are together and i still have a wife!  

I got the divorce after long time  and proposed to my wife and we got married after i provided the Original Divorce Certificate to register office and had the General registrar approval to remarry. ( Original letter Enclosed )

I have been working full time as Lifeguard and Swimming Teacher since first month i came here and paying Tax  .. my wife been studying English and now working part time and i am supporting her till she find a 

good job .

I just thought i would be honest and tell the whole true story.

If you need letter confirming my employment please let me know as i believe you only need the EEA national family member employment.

What do you think ENGLANDD? I was gonna mention she cheated on me and been lying to me we will move together etc but someone said don't accuse her and put ur self in trouple.. Just say u got divorce and u married now that's it

i do not think that there is need to mention too much about divorce details/reason/history or personal story as you already have a formal divorce certificate that is absolutely a legal channel. Just be precise and relevant based on your current circumstances.

You are right but a lot of people said that once I am divorced I am illegal here and I have to go back and UKBA might deport me even if I am married!! And I just wanted to answer any question mark for UKBA when they look at my passport and see that I was given enty clearance as UK spouse..

Received 19 oct special delivery

COA 25 Oct dated 22 of Oct :).... what make them send it that fast !!! 4 days in sat and sunday?

i cant believe it till now!! and do you think after that i will get RC soon?

May be will get refused after that?

We cannot predict ukba. You miraculously got coa very earlier. Just present it to your employer, relax, do not email/write/phone them, just wait. You are legal without rc.
