Tier1 General Extension (foreign earnings)

Post by aamirwani » Wed Oct 17, 2012 8:47 am

I am due for my tier-1 extension in may 2013. I have been on holidays in India (took career break from office) for more than 2 months now.. I would fall short of earnings if i only claim points from my employment in UK. I do run a business in India as well. I offer IT consultancy services and sell computer books to schools.

I would be flying back to UK in the first week of November 2012. however, that won't affect my business here in India as i do most of my dealings online. I am paid into my local bank account here in India. I understand as its an extension i won't be able to apply uplift to any of my foreign earnings.

My question is: -
Does my not being present in India make any difference to the documents required for my foreign earnings and does that mean i can only claim for earnings made in India whilst i was physically in India or can i claim points for my foreign earnings which would be made after i fly back to UK.

Also if someone would be kind enough to guide me as to what documents i would require to claim points for my foreign earnings..

Hi, I don' think there are any rules around this other than you can use your foriegn earnings to claim points and you can't use any uplift ratios (it has to be a direct conversion to GBP). The rest depends on what you can prove and whether your documentary evidence is enough to convince UKBA.

Do remember that they might want to do background checks like contacting your clients etc and so their decision might take longer than usual.
