Curtailment issue regarding tier-4

Post by CollUsman » Wed Oct 17, 2012 3:35 pm

Hi,

I am here in UK for the last 5 yrs on Tier-4 visa. I finished my PHD early and the University informed me that they have informed the UKBA that I am no longer student. So UKBA might curtailed your visa. They informed me on 01-08-2012. They advised me to switch to Tier-2 early Oct or leave the country (As it is 60 days max).

My Situation:

1- I have not receieved any letter from UKBA. I have written couple of times to UKBA (UK Border Agency, Lunar House, 40 Wellesley Road, Croydon, Surrey CR9 2BY), in recorded delivery, about my Immigration status and they are not replying. I phoned them and the lady asked me that who told you your visa has been curtailed (she was a bit surprised. I said her that my University tolod me that it might have been curtailed).

2- I am working in a company and the company dont have the Tier 2 licence yet. The company has applied for the licence and UKBA is processing it. Hopefully they will get responce this month (or next).

3- My Company sent email to UKBA about my case, dated 20-09-2012, by using the 10-days rule (The rule is, if a compnay has applied for the licence of Tier 2 and has some employee whose visa is expiring..then UKBA might speed up the process). But even after 3-4 weeks, the haven't replied.

I have no idea what is my status right now. And I dont want to live illegily as it is not good for my future immigration. What should I do now?

P.S.
I red somewhere, that If someone overstayed 28 days, it can affect thefuture immigration. I am assuming I am living illegily from 01-10-2012.

Thanks a looking forward for your adive pls!

What is the expiry date given of the most recent Tier 4 leave granted to you?

Do ukba have your current address?

Until then actually write to you to inform you that your visa has been curtailed you are still here lawfully.

I changed the address 1 month back on-line here:

https://contact-ukba.homeoffice.gov.uk/ ... y-details/

Is it correct?

What is the best way to know my immigration status? I talked to my University visa team today, and they told that the University revoked your tier-4 licence dated 01-08-2012. The curtailment of visa is upto UKBA.

I need to plan and I have no idea what is my status?

Thanks a lot,
