My fiancee ( settlement in UK ) and I ( Tier -1 visa) are getting married. We are considering to apply for the spouse visa instead of filing for Tier-1 extension, since my Tier-1 visa will be expiring next April. And here are my questions regarding my situation:
1. Can I switch the visa status ( Tier-1 to Spouse Visa) in UK ? The law is keeping changes, so I guess I get a little confused.
2. If my spouse visa application is refused for any reason, such as missing document or any unpredictable reasons,
a.Is my Tier-1 visa still valid so that I can legally stay and work in UK ?
b. What kind of option do I have if the spouse visa is refused ? Can I re-apply for the spouse visa or the only option I have is to appeal against decisions ?
2. Regarding the new rule, they have the financial requirement.
a. Who actually have to meet the financial requirement, me or my fiancee, the person who is sponsoring me ?
b. If it is me who have to meet the financial requirement, how much money in the bank I have to show if I don't have enough income to meet the requirement, as I just moved to UK and no UK source income at all.
