is our marriage legal in the UK?

Post by longhairedude » Sat Oct 20, 2012 6:42 am

I am from the UK but now living in Peru with my Peruvian wife who I have married now for 4 months.
I would like to know is our marriage legal in the UK as the British embasey here in Peru told me there is no facility in the UK to register any overseas marriage. .Does this mean our marriage is not legal in the UK?
If it is not legal in the UK do we have to be married in the UK or what documents is required for our marriage to be legal in the UK?

If it's legal in Peru, it's recognised as legal by the UK.

Yes our marriage is legal in Peru here. The reason I am asking is we want to go back to the UK and my wife will apply for a family permit then hopefully get residence as I will apply all for her when we get to the UK.

I assume you mean a spouse visa not a family permit?

The British government does not register overseas marriages. The best you can do is deposit you foreign marriage certificate with the GRO but this is not needed for immigration purposes. see the guidance from the British embassy below.

Depositing your marriage document is not a legal requirement.

You are unable to register a foreign marriage in the UK. As a general rule, as long as your marriage is valid and legal in the country in which it took place, it is likely to be recognised in the UK. If you are in doubt as to the legality of your marriage, please consult a solicitor.
