Varying application from FLR (M) to SET (M)

Varying application from FLR (M) to SET (M)

Hi,

Good evening to the members of this great forum.

Its regarding my wife's Application.

I got my ILR on 10 yrs long residence basis in Apr 2012.

I applied for my wife's dependent visa using Flr (M) in May 2012. She joined me in UK in Nov 2011 on Tier 1 (G) dependent visa.

She has given the biometrics in jun 2012 but after that there is no news from the Home Office regarding her Flr (m) application.

Now If we aren't wrong she is eligible to apply for ILR in Nov 2012.

We are just thinking to submit Set (m) application (Varying Application) to UKBA as there is no decision taken yet by the UKBA on Flr (m).

Are we eligible in varying the application from Flr (m) to Set (m)? If so what is the procedure like how to pay the fee's (difference), additional documents etc..

She will do the LIUK test soon.

Please help us with regards to the above.

Anyways, she cannot apply for settlement unless she is granted FLR(M) leave.

Sorry my wife joined me in Nov-2010.

But anyway according to you I can't make varying application.
