Hello,

I need some well knowledge persons help to find the right answers(so many people gave different kind of answers).

well!

I am right now on Tire 4 dependent and working in one of the company full time which is 41 hrs/ week with salary of £18000/yr.

recently i spoke to my Management and explained
i should be earning more then £20,000/yr to get sponsor,there are 2 ways
to reach it.
1.either they can send me to work night times which got £4000 as night allowance.
2.they can raise my contracted hours to 48 hr/week then pay will be£21000 (on pro rota basis).

they said they will look into and do the best one.

besides this

i did Professional Bachelors degree from India which is 4 yrs in English.
and i did Certificate in management from UK university.

now, i tried to calculate the points in PBS at UKBA by giving all with assumption of earning more then £20000 i got 70 points and shown i may eligible to apply(summary copy attached). https://www.points.homeoffice.gov.uk/gu ... ulator.pdf

Now my question
1. am i eligible to apply from inside the UK.
2. if my management gone for second option for reaching my salary will it be alright?
3.am i really eligible to apply with my Indian Bachelors Degree, without UK masters(NVQ 7 and above) qualification?
4.finally i am working in this company since last 8 months, if my company willing to sponsor me in next March i finish 1 year. am i still need to go for RLMT?

please advice.

1. For an employer to issue you a CoS, he must certify that you will be paid at least at the rate specified for the SOC relevant to the job that the employer intends to employ you in or at least GBP 20K, whichever is higher.
2. You need to score = 50 points for "attributes" + 10 for Maintenance funds + 10 for English language.


Coming to the questions:
1. Yes.
2. No one can tell you for sure unless they know your SOC code.
3. The job that you will be sponsored for must be at NVQ level 6 (unless it is in creative sector, where NVQ level 4 is acceptable). Your qualification from India or UK or anywhere is irrelevant here.
4. Unless you will be sponsored for a job on the shortage occupation list, your employer will need to complete RMLT.

Here i tried to find the SOC but i am not sure which one is considering our HR.

My designation is QUALITY CONTROLLER there are two SOC relevant to my job tasks 3115 and 8133.

how ever if it is the SOC 3155,
it required NQF level 4 and £9.80/hr Min pay
(Ref : Section N - Administrative and support service activities).

my current qualification is equivalent to NQF level 7.
current rate of pay £9.322/hr.

will it be alright or must need to be more then specified?

for this SOC is RLMT must? even though i am working 1yr on same role with same company?

Level 4 job will not be qualified for tier2 unless its on the shortage list.
