Fresh Application vs Appeal

I was refused by UKBA, but offered to appeal. My visa expired months ago now, Can I apply for fresh application or just carry on with the appeal?

whatever the reason(s) for your refusal or the basis of appeal are, you have a limited time to lodge appeal. You will have to leave within 28 days if you don't appeal or in case your appeal is dismissed.
