Calculation of 5 year stay for ILR

Post by tier1uk2010 » Tue Oct 23, 2012 8:38 am

HI All,

Thanks for your all this support and help. I have query about the calculation of the gap for fulfillment of 180 out of country for ILR:-

My Tier1 (General Visa ) stamped Date - 8th January 2010
I entered UK on 4th April 2010 ( within 3 months)
I went bak to India on 9th April 2010.
Came back to UK on 18th June 2010
Out to my country on 11th December 2011
Came to UK on 28th December 2011

I will go to India in 2013 for 1 month:-

So my query is that I am going to extend the visa on 8th january 2013 and it will be extended till 8th January 2015. For filing the ILR in January, Do I need to again extend my Tier1 visa or the UK border agency will consider my fir gap as I entered in UK within first 90 days.

Also for 5 years completion , rule is -you should be out of country for maximum 180 days in 5 years. So whether they will calculate out of country from 8th Januray 2010 or from my first entry in UK (4th April 2010).

If any could reply my query will be highly appreciated.

Thanks
Raj
