New visa refused but previous visa not cancelled

Hi,

My mother in law is coming this Christmas because we are having a baby. She initially applied for a 6-month visa in June and was granted one that is valid up to January.

As we wanted something valid till february or mars, I decided to apply for a new 2-year visa in october.

The visa was refused because I was missing some documents which I now have.

I have contacted a lawyer to seek advice whether to appeal the decision or use the existing visa (that was not cancelled). She advised that although the visa was not cancelled, there is a big chance that she will be refused entry to the UK as there is a black stamp at the end of the passport with a date later than the date of the issued visa.

My question is:

1/ can she still use the existing visa and come to the UK in november or is there a big chance she will be refused entry?

2/ shall I apply for a new 6-month visa with all the missing documents and she should receive it to be on the safe side?

I will appreciate your advice/input.
