Hi Everyone,

I am also in the similar situation.

I have got the Entry Clearance on 10th Mar 2008 but I entered UK on 8th June 2008 that means I arrived UK 2 days short of 3 months.

I complete 5 years on 10th Mar 2012. Am I eligible for ILR when though I entered UK 88 days after my EC?

In addition I am out of UK for 120 days during my stay(from 8th June 2008 until now) - Holidays

Your inputs would be much appreciated.

Yes you are eligible. I also came 68 days late and got ILR, no questions asked

I have read your other posts and I am now confident enough to go ahead with the ILR keeping aside my confustion of another extension.

Probably few more clarifications needed in my case
1) I was on HSMP for 2 years and then Tier 1 General - I think this is also ok for me to go for ILR directly?
2) I entered UK after 88 days from my HSMP Entry Clearance. I am just in the 3 months clause by 2 days - Considering this is it advisable to go through Solicitor or shall I manage my own?
3) I have a Dependant and she has been with me in the UK for less than a year - How should I get her visa extended? What would be the visa type for her as I am taking ILR? Can we both apply at same time?

1) you are correct
2) no need of a solicitor.
3) i believe your wife would not be eligible for ilr as there is a 2 year minimum cohab requirement for ilr. She might have to go for extension. May be a more senior member can advise?

Can a Senior Memeber advice me on my wife's visa?

If I take ILR which visa my wife should apply for as she hasn't been with me for 2 years?

Also, I hear that dependants need to clear IELTS for proof of english skills? My wife degree was taught in English and can produce a certificate. Does she still need to take a seperate english test for her visa extension?
