I am so stressed with all this that I apologise beforehand if this topic has been previously discussed and I did not read it.

Separated from a Spanish national, after over a year of being married. He left the country. I do not know where he is. Grounds for divorce: irrational behaviour (drug abuse).


I have a applied to permanent residency as my EEA visa expired;however this has been declined. I have been advised to appeal. My divorce has not yet been finalised and I cannot prove that my ex husband is exercising his treaty rights in the UK as he disappeared. I have called several places in where he used to work. They are not willing to give any information out. I also called Inland Revenue on the off chance they would advice where to access his records. They decline to give further information, which I understand.

What to do?
At present I am going through the motions; but feel that there is no hope.

Advice please.

The problem is, at present the EEA national is not in the UK or you don't know his whereabout, you are unable to show evidence that he has resided in the Uk for 5 years in accordance with the EEA regulations, you have not yet got a divorce, and have not got a CSI on behalf oy you and him. All this make your case a bit tough at present. It is difficult to see how you can proceed. I believe you should have worked on the divorce, when you realised that his drug habit was adversely affecting your relationship.

Thank you for your honest reply.

My divorce procedures started last year (June). We send the papers to his mothers' in Spain, but no reply. I am trying to translate (with a certified translator) a couple of emails he sent me to prove to the court he has received them. The judge cannot divorce us unless he has enough evidence he has acknowledged the paperwork.

It seems I have no hope...
