Tier 1 (PSW) Dependant to UK Tier 2 (Employer Sponsored)

Post by ydependant » Wed Oct 24, 2012 5:27 pm

Hello all,

I have a Tier 1 (Post Study Work) dependant visa which expires on March 30, 2012. I was hired by a company a year ago. The company has a sponsorship license and going to issue sponsorship certificate for me.

So I have two questions:
1. Could I switch from Tier 1 (Post Study Work) dependant to Tier 2 (Employer Sponsored) visa ?
2. Can I apply for the visa half year before my current visa going to be expired ?

I tried to find information about the question on internet but without success.
Could someone give some advice or link to place where I can find answers to the questions.

Thanks in advice

1. No you cannot switch in country you have to apply for entry clearance. You employer will need to issue a restricted cos and undertake the RLMT unless your job in on the shortage occupation list.

2. Yes.

Thank you for your answer.

So, do I have to leave the UK, apply for the Tier 2 in my home country and wait for the Tier 2 visa and only then I could back to the UK with a new visa status ?
Did I understand this correctly ?

Is there any chance to get Tier 2 from overseas?
I hear it is very difficult.

There is no restriction in the immigration rules that states "if someone meets the immigration requirements but applies from outside the UK entry clearance will be issued with difficulty".
