Visa Expires 5 Days before Gradustion - Possible Extension??

Post by Maddox » Wed Oct 24, 2012 8:13 pm

Hi all the issue is Narrow and ill try to concentrate on it as much as possible:
>>Current Leave to remain under T4 due till November 21
>>My MSc Graduation date will be on 27
currently employed by a Tier 2 A rated sponsor and was in the pipeline of getting sponsored in to Tier 2 Visa and thus not having to worry about having not to attend Graduation due to expiry of Visa and Graduation but sponsor got back to me saying they have no COSs which now leaves me in a situation>>(Graduation, which i have already booked including letters for parents to attend)
I have been made aware that T4 visa extensions to attend graduation are not allowed no more and my Uni says I have to return home and apply for visitors visa.
1st Draw backs on this is obviously the expense of flying back home (£6-700) and then flying back here almost same cost etc etc that's minus parents who also intend to come. And also at least £1000 or more to ship my stuff back
2nd Draw back, with the time left >>Visa applications processing is no longer done in my country (used to be Next day service) but now all applications are now done in South Africa for countries in southern Africa and takes up to 4 weeks minimum or more.

Question:As obviously circumstances vary:Has there been anyone faced with a similar case and If I write to the UKBA regarding my circumstances ,would they be able to agree to extend locally as the days between expiry 21st Nov and ceremony date 27th Nov is literally just 5 days ??

Thanks

Although the rules do not allow but what you can do is that when your visa is about to expire (say 5 days before) put an application for extension of your current leave. You can write a cover note with your application that why are you doing this and request them to consider your application under compassionate circumstances or whatever. Now 2 things can happen they can either reject your application (or even send it back unprocessed) or accept. If its the latter then its great but in other case you will have gained enough time to attend the graduation ceremony and will also have proof that you did stay more than you were allowed to. Don't forget to keep record of postage and everything. If and when you apply for entry clearance again, you can always mention this fact that you applied for extension from within the UK but it was refused or returned invalid. That is my understanding of what you should be doing but you can wait for seniors to comment on this.

Oh and needless to say if you do find any sponsor in the mean time, you are always welcome to apply whenever possible. :)

A word of caution, should you choose to follow the suggestion(s) made above. Read 320(11), which includes " vexatious and frivolous applications" - and may influence outcome of entry clearance application(s) in the future.
Life isn't fair, but you can be!

You see! Thats why I suggested to wait for some others to reply. A word from boss in this case which also adds to my knowledge. 8)

Anytime. If I knew such rule(s) existed, I would never have advised you that.
