Can someone help please?

Recently my sister made a joint claim for tax credits because her partner with a spouse visa (No recourse to public funds) joined her. She is self-employed working from home. Her husband is mentally ill and unable to work at the moment.

After three months she received a phone call from the specialist tax credit team asking for further information.

They have asked for various documents such as identity documents for the children, bank statements and emoyment details etc.

I have spoken to the person who has been dealing with her claim and she asked me few questions which is worrying us.

She said that my sister needs to prove that she can support herself, two children and the husband without recourse to public funds or atleast she is trying her best to support without public funds.

She also said that my sister should be able to support herself if the child tax credit is not granted. In addition to this, my sister needs to prove that she is earning enough from her self-employment to cover all her expenses that includes rent, council tax, bills etc.

My sister currently recieves child benefit into her account, she is also getting rent from the local council into her bank account. From her self-employment she will be unable to prove to the specialist team that she can support her family without recourse to public funds.

I am confused i serously do not know what to reply to that lady and realistically she was really rude over the phone. My sister has ILR and her two kids are british citizen. The only problem is that her husband has a spouse visa with no recourse to public funds which is clearly stated on his visa stamp.


Can someone help please?
