I am a british citizen and my partner is from tunisia. We have a 5 week old daughter who is also a british citizen.
My partner came to the uk in 2006 on a spouse visa with his ex wife. The relationship didnt work out and they divorced in aug 2011. He since then appealed to the home office to stay in the country in his own right through a lawyer and was refused.
We have been together since apr 2011 and i fell pregnant in jan 2012. This wasnt planned . We then had a marriage ceremony in a mosque and planned to have a registry office ceremony when he got his passport back.
Because the home office refused him we had to go to a tribunal in bradford. I was there as a witness and explained that i was unable to leave the uk as i am currently doing a degree and i also cant speak arabic so would have no support if i left the country with him.
The judge refused him and the reasons were because we didnt plan the pregnancy (which i find really weird), that i would be supported by his family (even though they dont speak any english) and that our relationship is basically fake.
We are now waiting to hear if he can appeal in the high court.
I was just wondering if anybody has been in this situation and could offer any advice or their experience. I am worried that i will have to leave the uk to keep my family together even though it would mean giving up my studies and living in a country where i cant speak the language.
