Hi to all,
There is a possibility to have a job offer at 20K, after workout my soc code the min salary for my position works out at 27100£ based on 37.5 w/h. Unfortunately my sponsor won't match that but it is willing to reduce my working hours (28 hours) to match the salary requirement (I will be in a junior position/training).
Is that acceptable for my visa application ?

Working 28 hours a week amounts to 25%-30% decrease in normal working hours. If such amount of reduction in working hours is viewed as part time working (which I believe it would be but I stand to be corrected), then the following applies:
Tier 2 policy guidance wrote:67. If you will be working part time, you will be awarded points for your actual earnings and not for the equivalent full time earnings.

From what I have gathered lately, as long the Code of Practice says that you can pro-rata and you don't go below £20k, you should be fine. And I believe if it a shortage job then you need to work at least 30 hours a week.

Hello Guys,
As per my understanding your salary requirement will be based on the SOC and you must be working 37.5 hours to meet that requirement.
30 % reduced in number of hours is something to do with redundancies policy etc but i m not too sure about this.
but please make sure you check the SOC according to your job title and match the required salary according to your SOC otherwise it is not valid and 20K plus requirement is not valid anymore.

Say if i am in £23k now..am working 40hrs/week, but my SOC shows £30100k for my role...
So do you mean, even though I am earning above 20k, am not meeting my salary requirement?

Hi Raj,
Yes u r correct if your soc code shows minimum salary of 30000k for that soc and you are earning 28100 than you don't meet the earning criteria and also your earning should be based on 37.5 hours per week.
This is what my understanding is but if I am wrong than plz correct

From SOC guidance,
Appropriate salary rates are based on a 37½ hour working week, unless
otherwise stated. Salaries should be pro-rated for other working patterns.

Yes, if the 30100 given in SOC is for 37.5 hours.

It looks like I should get paid for
(2.5hours * 52 weeks in a year = 130 hours in total/per year..)
so my salary requirement will be £30100 + 130 hours pay(for 40hrs/week working), in order to meet my SOC salary requirements..
