Making ILR application but wife receiving CB

Post by Inahurry » Mon Oct 29, 2012 12:35 pm

Hi
I am about to apply for an ILR (having wife and daughter as dependants) but just realised that my wife is not entitled to the child benefit we have been receiving. I had not been keen to apply to CB because my visa states no recourse to public funds, but we were encouraged to apply at the time, disclosed our situation to the HMRC within the application, and received a letter at the time saying she was indeed entitled. But i now see we are not - both myself and wife are Brazilian nationals on my Work Permit visa.

She has called them this morning to cancel the benefit and try to pay the money back, but I don't think they will be able to confirm the cancellation before we have our PEO appointment in Belfast.

My questions are: 1) how do I reflect that in my SET(O) application? (since it is my wife who's receiving the benefit) 2) should I postpone my appointment to wait for some confirmation from HMRC that the benefit has been cancelled? (or is my application chances of success doomed in the first place)?

Thanks in advance for your help.

I believe your partner has also registered and has posted the same query.
