Hi i am British citizen and i got married in 2010, my wife got spouse visa(Settlement Visa) on 29 November 2010 valid visa till 28-02-2013 My wife came to this country on Dec 12-2012.

i am trying to book the appointment at PEO on dates from 19-11-2012
is that OK to apply the ILR from 19-11-2012.

I would assume you mean 29 November 2010 not 2012

Yes the 19 November should be fine.

do i need to show my bank statments as i dont have and i am unemployed from june 2012 we are using joint accnt and we have savings 1200 pounds
and my wife working full time she got pay slips for 1 year and i got my payslips for june 2012 is that ok to show them my previous payslips.

You will be assessed through the pre-july 9th rules. So:

- You will need to show weekly income of around £112 if have no child
- You can combine yours and your partners earnings or use either ones
- minimum 3 months payslips but 6 months would be best
- minimum 3 months bank statements but 6 months would be best

All other requirements are almost the same as the spouse visa with an addition to show both of you been living together in the past 2 years. This is usually established with about 6 different documentary evidences with in the last 2 years from different organisations i.e. bank statements, NHS letters, Jobcenter, HMRC, driving licence etc etc.

As long as after paying tax, rent and council tax you are left with £112 per week it is fine.

Set(M) applications are rarely refused on finances as the major aspect assessed of as part of ILR application is if your marriage is still subsisting after two years and you intend to live permanently with your spouse,have passed KOL test and as long as you or your sponsor can support you without recourse to public funds and have not recoursed to funds during your probationary period then you will be fine.

Look through the forum and there are plenty of examples where people were in far more worse condition then you and were still granted ILR.
