Baby born in UK and Citizenship by Birth

Post by gammasingh » Wed Oct 31, 2012 8:02 am

Hi.

Me & my wife have been blessed with a baby last week.

We both are students in UK. I am from India and my wife is from Uganda.

1. Will the baby have British Citizenship by birth?
2. Can we apply for indefinite leave to remain in UK on the basis of the above?

Your help and guidance will be very much appreciated.

Thank you.

Why are you asking people to vote on this issue?

1. The baby is not British.
2. No.

Thank you for the reply.

OK, so if the child is not a British Citizen by birth, then how can we proceed with our application to extend our stay in UK? Is it possible?

I am currently working (after completing my MBA) and my wife's student visa is valid till March 2013. She has also got her deferment from the University for her exams.

Kindly guide us about steps to file for ILR, that is incase this is possible?

Is asking people to vote on this a wrong idea? If yes, please allow me time to remove the pool option.

Thank you.

The concept of an 'anchor baby' (a child born in a country who is automatically granted citizenship, and the parents can remain on that basis) is not a generally available option under UK immigration laws. Here in Brazil it's all the rage!

You both must continue on your current status (and comply with the conditions for that category) or apply for another immigration status (having complied with the conditions of your current immigration category).

When did your course finish and when does your leave expire? As for your wife, getting a deferment for the exams is great, but is she still considered by her sponsor as someone actively on the course of study; is her absence authorized?
