Tier 2 - Switching Employers

Hi, I know there are already many posts on this topic but my query relates more specifically to the BRP.

I currently have a tier 2 visa (issued in June in Australia). I have a job offer with another company who are currently advertising the role for 28 days. At what point do I need to apply for BRP? Is this something that I can do when I apply at the Pubic Enquiry Office for my new leave to remain? Or do I have to organise this beforehand and bring it to the appointment?

I'm just confused because I was never issued with a card although I had my biometrics taken in Australia when I first applied.

What is the most straight-forward way of applying for the BRP (most time efficient) and when should I do this please?

PEO application - biometrics will taken on the day of the appointment.

Postal application - After you apply for leave to remain under sponsorship from the new employer, you will receive a letter from UKBA some weeks / months later requesting you to enrol biometrics.

Hi - thanks for your response. I wonder if you're able to help me with the rest of my queries?

My new potential employer has just requested an increased allocation of unrestricted COS in order to assign one to me. My questions are as follows:

1. How long should it take for them to allocate it?

2. Once they have done this, does the company need to send supporting docs re: the job they advertised?
I am just worried because I was first approved under the pre June 2012 rules under a SOC code that isn't NQF 6 - although I have received confirmation from a UKBA helpline rep that the old rules will still apply for my application, I don't feel confident so want to know at what point I would find out if it is acceptable.

3. With regards to the PEO application - what is the process for the appointment?
I know I have to book the appointment online but am I able to do this before I have my COS? What is the turnaround time if I got my COS today for example?

Any help would be appreciated, thanks.

1. Can be between "within minutes" to "Couple of weeks / months". Only UKBA can answer this question.
2. A CoS will be issued only if the prerequisite requirements have been completed and mentioned when applying for CoS. Read the policy guidance for details on the requirements.

1. Thanks, that's what I thought.
2. Ok, so after it is allocated (probably in a couple of weeks time), the compnay will assign it to me and the company will be notified (when?) whether the CoS is granted/issued or they will request supporting evidence/docs. Which policy guidance are you referring to here, as I can't find anything that is specific to my situation?

2. I believe the a sponsor is notified about refusal / approval of a CoS through the sponsor management system (SMS).

2. iI you applied for your present leave on or before 13 June 2012 the job needs to be at least NQF level 4. If you applied on or after 14 June 2012 the job has to be NQF level 6.

If your sponsor has a T2G CoS allocation available for you, and they completed the RLMT, they can assign the CoS to you immediately (it is an online process). In the CoS they have to certify that they completed the RLMT and provide its reference number.

Great, thanks to both of you for your replies.

RMLT has been completed and they have the supporting documentation.

I believe they are just awaiting the COS allocation as they neglected to request an allocation of unrestricted COS when they applied for their license.

Hi, I have another question - my employer has said that there is no record of an oustanding request in the SMS anymore. It was showing when they initially requested it but now they cannot see anything.

Should I be worried? Should they request another allocation just to be sure or contact UKBA about it?
