Help on Section 9 in SET (O) form for Tier 1 to ILR

Post by mrneo » Thu Nov 01, 2012 12:20 am

B4. Please tick to confirm the documents that you have sent as supporting evidence of the qualification for which you are claiming points.

1)Evidence is not required for current application because it was submitted for a previous Tier 1 (General) application
2) Original certificate of award
3)Original academic reference from awarding body and original academic transcript
4)Original academic reference alone

Which one should i tick as i am doing my ILR from Tier (1) extention. I believe it is the first one. But my solicitor didnt tick any of them. I have my application with me and i am applying today at belfast PEO

Any thoughts ?

Hi Tejomon,

arifahmmed is right. Select the first one. Also take the original certificate with you , just in case.

I selected the first one for my ILR last tuesday.

SETO Section 9

Post by SONAKSHI » Sat Dec 15, 2012 1:25 am

Hi, I came here on a dependent visa in May 2006 and started working and also doing a modular MBA. I got nmy own HSMP in July 2007. I later went to my home country and applied for my own HSMP visa and returned to Uk in jan 2008 on HSMP visa. I applied for extension and got in Jan 2010. Subsequently I completed my MBA in April 2010. I am applying for ILR now. In B3 of section 9 of Set O, I note the following.
Bachelor’s degree* 30 points
Master’s degree 35 points
PhD 50 points
You can only claim points for a Bachelor’s degree level qualification if you have previously been granted
leave to enter or remain as a Tier 1 (General) migrant under the rules in place before 31 March 2009 or
after 5 April 2010; or as a Highly Skilled Migrant, Writer, Composer or Artist or a self employed lawyer.

Does that mean that I cannot claim points for my master's degree (MBA)
Many thanks in advance

No worries. Yes, you can claim any higher degree than your batchelor degree.
Rules changed after 5 April 2010 from when batcher degree was not granted for Tier1 instead minimum education level set to masters degree. Those people can not claim or go back to batchelor degree for ILR. But all candidate claim for higher degree.
Look at beginning at section B
If you have gained further qualifications since your last application for leave as a Tier 1 (General)
Migrant and wish to claim points for this, you must provide evidence of this qualification
as specified below
.
