ILR and dependant on Tier 1 general

Hi

I hope someone on this board can help me. I am going for ILR in feb 2013 from tier 1 general and my wife is my dependant. She got her dependant visa in August 2012 and her visa expires same time as me.

1) Can anyone let me know if I have to apply for her visa at the same time as me?

2)Which application form should I use for her visa? FLR or ILR?

thansk for reply. I understand I will have to wait for my wife ILR 2 or 5 years(whichever is applicable)

but my question is " Visa of my wife expires on 15th of March 2013, same date as my Tier1 expires and I have appointment booked at window on 15 of Feb 2013, should I apply for my wife's FLR same day same appointment? or Do i need to get my ILR first and then book seperate appointment for my wife(FLR)?

Your choice - whether you wish that your wife applies at the same time as you or on the last date of her current leave or any time inbetween.

No, she will need a separate appointment for herself if and when she wishes to apply in person, even if it on the same day as your settlement appointment.

thanks for that :) . I have another question I will be glad if you can answer that.

We got married in March 2012 in UK(registered in UK) , I was living in UK as tier 1 migrant and she was living here in UK on student visa.

But she got dependant visa on 31st of July, does she fall in 5 years category or 2 years category?

When she "got" the visa is irrelevant. When she applied for it defines which rules will be applicable to her. The linked topic contains explanation of the relevant requirement(s) and also links to the specific immigration rules.

thanks for that, she applied for dependant on 22nd of July and and 5 year rule starts from 9th if July. So i understand from this she falls in 5 years category.

But We got married in UK in march 2012 and we were living together since march 2012 and we registred in uk.

So she was declared my wife in UK from march 2012 but she was on student visa.

Will they consider her my dependant from March 2012(when we got married and lived together in UK) or when she applied for dependant visa?

If they consider her my dependant from March then she falls in 2 year category?
