I would like to take an advice on the ILR eligibility of my wife. Details are mentioned below.
Main Applicant - Tier 1 (General) History:

Extension granted: 23-Nov-2012
Visa expiry: 23-Nov-2013
Dependant –Visa history:
Got married: 12-Sep-2011
Visa granted: 4-Jan-2012
Entered first in UK: 3-Mar-2012
Visa expiry: 23-Nov-2013
My wife is planning to go on holidays for 2 months next year and I am planning to apply for ILR on 4-Nov-2013 at PEO.
She meet 2 years marriage requirement and there is a 3 months grace period as per UKBA website.
Q. Can my wife apply for ILR at the same time?http://www.ukba.homeoffice.gov.uk/visas ... ettlement/
If you delayed your entry to the UK
If you were given a visa in this category but you then delayed your travel to the UK by up to 3 months, you can apply for settlement using application form SET(M) shortly before your visa expires. Provided you meet all the other requirements, we will put your application on hold until you have completed your 5 year qualifying period in the UK.
Q. Does 2 months period has any significant affect on the ILR application?
Thank you.
