Tier 1/ ILR query

Sorry if this is a silly question but i am really worry as i have lost my job/ contract and concern about my extension or ilr.

my ILR is due in august months and i am out of work since yesterday. i have worked all along and if i have not worked until next august from now so just want to find out:

- then i would not have worked in last 10 out of 15 months then my 5 months earnings would be from october 2012 to may 2012 in which my gross earnings would be around 25k that should give me 20 point (Tier 1 applied in july 2009). Would this be OK!
- my september and october earning is working as limited company contractor so wondering if i need to consider my earnings in the invoices excluding VAT or including.

1. Read 84.
2. Read 92 or 93, as the case may be.

If 93 applies then your accountant will be able to compute net profit using invoiced payments and business associated outgoings of the limited company.

Just please give specifc advise for this as I have read the 12 continuous months earnings (out of last 15 months) and still unsure:

If I apply for ilr next August and if i will not have worked from 31/10/2012 till then, then will I be able to go back to May 2012 and start counting 12 months from there i.e.will I be able to clam points for my earnings for months from May 2012 to October 2012!!

Please advise.
