ILR 5 years route for dependant or 2 years?

Post by saudbs » Fri Nov 02, 2012 3:54 pm

Hi All

I have question regarding dependant visa of my wife. I am on TIER1 visa in UK and going for ILR feb 2013.

My wife applied for tier 1 dependant on 22nd of July 2012 and 5 year rule starts from 9th of July. So i understand from this she falls in 5 years category(for ILR).

But We got married in UK in march 2012 and we were living together since march 2012 and we registered in uk.

So she was declared my wife in UK from march 2012 but she was on student visa.

Will they consider her my dependant from March 2012(when we got married and lived together in UK) or when she applied for dependant visa?

If they consider her my dependant from March then she falls in 2 year category?

Thanks,
