Student Visa Rejected, Re-Applying for another Country

Post by skh2012 » Sun Nov 04, 2012 2:54 pm

Hello guys. I have a problem and I really need advice. A few month ago I got admitted to a University and I applied for a student visa. Unfortunately my application was rejected. Now another opportunity has come up and I have been admitted to a university in another Schengen member state and I want to apply for visa again. Meanwhile, I have got my passport renewed and therefore the rejection stamp does not exist in my new passport. Although the reason of rejection does not exist in my new application case, I strongly prefer to not divulge the rejection letter to the immigration authorities of current country I am applying.
now I have a few questions:

1. Is what I want to do, technically against the law?
2. Is it possible? I mean I want to know if there exists an online database for long-term Schengen visas and that the immigration authorities could find out about my previous rejection case anyway?

As you can guess, this visa application is really important for me. I really appreciate if someone gives me an insight. Thanks in advance.

You should not lie and nobody here is going to tell you to do so. It's really a matter of what questions are asked on the application form. UK visa applications ask all applicants if they have previously been refused a visa to any country. If your intended host asks a similar question you must respond; otherwise you don't have to volunteer this information if it's not asked.

I understand but the thing that matters for me the most here is that whether I have to provide the original letter notifying me about the reject or a personal description will suffice? Anyway thanks for your advice.

Are you not able to read the application form (for a student visa application for a country that you have not mentioned)? If this is a necessary requirement, it would have a question asking for that information.

I had read the application checklist before and surprisingly it does not contain anything about providing reasons for possible previous visa rejections. but I still suspect it is possible that they ask me about this during the visa interview and I do not want to become surprised by that. I am asking this more from the legal point of view than some embassy's visa application checklist. What I sense is that even if they ask me about my previous reject case, I am not obligated to provide the exact notification of reject letter and a personal description will suffice. My reason is that the letter which have been given to me is something personal and in fact confidential and a third party could not ask me to divulge it to them. I want to know if I am guessing correct or not?

Whether or not you are interviewed, and whether or not you have rights to withhold information that is asked of you at an interview, and still have a right to a visa having refused to answer questions, is entirely a matter for the immigration rules of the country where you intend to apply for a visa (and have not mentioned in this discussion). Good luck.
