Pending application (EEA2) - Right to travel?

Pending application (EEA2) - Right to travel?

Hi,

My partner's previous visa expired and we have now followed the EEA2 route. My partner and I have submitted our EEA2 application (unmarried partner) and it is currently being processed. We have received our Certificate of Application which clearly states that our application is being processed and that my partner has legal right to work in the UK. We are now considering going back to our home country for the Christmas period however we question the risk that we may face upon re-entry back into the UK (as the application hasn't been fully granted). Will it be sufficient enough to provide the Certificate of Application along with a copy of our submitted application (if required, photocopy of course)? Is there a risk that my partner would be denied entry back in?

My partner has called UKBA and they were very dubious about relaying any information in regards to this situation.

Any information or past experiences would be greatly appreciated.

Honestly,NO...my application(eea2) is pending too its 1 month already.
i have a friend who has a similar situation like your's who took a risk of leaving the country asking his passport back to travel.on return he was denied by the air crew to board the flight as he had no valid visa.on showing his COA they disagreed to entertain him and left without him..and this happened just a week ago.Now on consultation he's been ask to apply for a EEA FP to re-enter while his eea2 is pending here...he's in real big problems now.

so by this i can advice you to not to do so.But the choice remains your's may be you both may become lucky but rare chances,could say 0.001%.

I disagree.

It would depend if the OP is visa national or not. With CoA, he should face no problem entering the country assuming he can get to the border and board a flight. I believe the OP is Australian so I don't foresee problems boarding a flight.

Thank you both for your replies. I am an EU national and my partner is Australian. Her T5 has expired hence the EEA2 path. We have seen the forum post below and the situation is almost identical. The answers seen at both URL's are contradicting. To be frank, we are confused as there is no UKBA guidance anywhere on this and the answers have been convoluted.

It is still a risk and we do not want to end up in the same situation as posted above :(

I was in a similar situation when I applied for my EEA2.

I (non EU national) applied for my EEA2 and received my Certificate of Application. I still hadn't received my passport back with my visa after many months and I had to go back home for a family emergency. I was forced to request my passport back so that I could travel. When I got home I immediately applied for an EEA Family Permit so that I could return to the UK without any issues at border control. Once I got back to the UK I sent my passport back and received my EEA2 a few weeks later.

The only stressful part of this process was praying that my family permit would arrive in time before we were due to fly back to the UK. This worked out for us and I had no problems when returning to the UK as I had a valid family permit which was valid for 6 months.

Hey confused99, I'm sorry that you're in this situation and I don't have any advice for you! I was wondering though if you already have your passports back? If so, how long did it take you to get them back from the UKBA after your request? Swish, if you could answer the same question I'd be grateful!

If your travelling abroad, you can ask UKBA for your passport to be returned back to you. Once you recieve your passport you can travel abroad.
While abroad, UKBA might issue your Residence Card on A4 Paper as they would not have your passport.
After your Residence Card is recieved on your address , you can get someone to post it through DHL to which ever country you would be in.
And finally you can travel back to UK on your RC without any problems.
