hello every one

my brother is applying for ilr next week ,h got married january 2007and he divorced 2011 the wife work from 2007 to 2008 and claim self employ since 2008 to 2009 cos of the problem they are hving they divorce annd then she went on job seekers allowancefrom 2009 to 2011 when they divorce pls help will this affect his application and also what can he do to cover the 5 years treaty right of his ex wife the good thing is that they are in good term

Is your brother able to ask these questions; it's quite difficult to understand what you have written?

What she is trying today is that
I got married January 2007 then dec 2007 I was issued resident card
5yrs
My wife is Irish but unfortunately we divorce in feb 2012
From 2007 to 2008 my wife was in full time employment for 1 year then due to her losing the job she was doing a business and she was self employ for 2 years from 2008 to 2010 then from 2010 she started claiming job seeker allowance till we divorce in feb 2012 and nowi want apply for my ilr but I don't know cos she was collecting JSA for the 2 years may be IT will affect my application

Did your wife have PR or acquire PR at any time during your time with her? Your right to PR is entirely dependant on her exercising treaty rights (or having PR) up to the time of the divorce, then the burden would switch to you showing that you were engaged in an activity akin to treaty rights after the divorce.

No she never apply for pr cos she is Irish and she has been living in the uk since she was 5years old and she irish passport and she has never live outside of uk and Iam also working from the 2007 up till now , I hv my p60 for the whole 5 years

Well that is better news, as it means she has automatically been granted PR a long time ago. All you have to do now, is prove this

So wat u are saying now that collecting JSA for the two years prior to our divorce will not affect my application?
