ILR for the baby staying overseas currently

Post by thinkdudes » Thu Nov 08, 2012 12:46 pm

Hello,

I am eligible for applying ILR in Feb 2013 (TIER 1 dependant).
I came to UK Dec 2009 and went to India for the maternity leave and the baby is born there and she was here in UK for 6 months (sep 2011 - Mar 2012) and currently staying in India..Is it possible to apply for ILR for the baby!!!
Does the baby need to complete 2 years before applying ILR?
Can the baby be in India itself while applying for ILR?[/b]

ILR can only be applied for from within the UK.
There is no residence requirement for minor PBS dependant.
No.

What is the immigration status of the other parent?

Best to wait, because:

If the parents have settled status when a child makes an entry clearance application (as child of settled parents) from outside the UK, then the child will be issued indefinite leave to enter (ILE) if the entry clearance application is approved (297(a)(i)).
