Please help... Tier 1 General visa extension query

Please help... Tier 1 General visa extension query

Hi,

I got my Tier 2 Intra Company Transfer Visa stamped in Aug 2010 and came to UK in the same month.

In January 2011 I switched from Tier 2 ICT to Tier 1 General.

I am planning to apply for my Tier 1 General Visa extension in December.

My question is whether the period of my Tier 2 ICT stay of 5 months i.e. Aug 2010 to Dec 2010 will be accounted for my ILR or not?

I read somewhere on UK BA site that only the period on Tier 2 ICT with the rules in place before April 2010 will be accounted for ILR.

How does that 5 months matter, any way you will get 3 years now, so 5 years is sufficient. Take it esay.

Thanks from such a prompt reply..... I have to attend a marriage in India in December. Hence I want to apply using same day service as early as possible.

If the Tier 2 period is accounted for ILR, then I can go ahead and apply for Tier 1 extension any time from now.

Hence this question.... Thanks!

(viii) as a Tier 2 (Intra-Company Transfer) Migrant, provided the continuous period of 5 years spent lawfully in the UK includes a period of leave as a Tier 2 (Intra-Company Transfer) Migrant granted under the Rules in place before 6 April 2010.

So I believe that the answer is NO. As I got the Tier 2 ICT visa stamped in August 2010, as per the new rules the period of 5 months will not be calculated for ILR. :(

why are you worried

your tier 1 visa

from Jan 2011 - jan 2013 ---2 years

now when u r applying at PEO in December
you get

jan 2013 - jan 2015 ---3 years

total 5 years, you are covered.

in Jan 2015 you will apply for ILR, you should be fine mate...

Thanks for the reply. Its my mistake that i didnt provide more information.

My visa expires on 25th january 2013. I wanted to apply for extension either in end of November or 1st week of december as I want to go to India to attend my sister's marriage.

Hence I was curious to know whether the Tier 2 ICT period is accounted for ILR or not.

sorry for thinking out too loud... but if you are planning to take PEO appointment then why dont you plan for jan appointment? If for some reason you dont secure timely appointment you can go ahead with postal application in jan... i am sure you must have thought of this but any reason why you are not considering this?

As mentioned earlier, I am going to India to attend my sister's marriage. Planned vacation is from 20th December to 20th January.

Visa expires on 24th January. As i dont want to take any chances, I am going for PEO in December.
