Tier 2 application - change of employment

Post by jcjvou » Fri Nov 09, 2012 7:46 am

Hi,
I am in tier2 and also planning to change the employment. new employer is ready to apply for new CoS. i need 40 days notice to current employer.

when shall i notify? i am planning to arrange in person appointment for new visa application. How long can i continue working to current employer (any legal obligation) once i have the sponsorship changed to new employer?

or is there any alternate suggestions? i wanted to keep it safe and legal.
many thanks

do nothing until you have the CoS from the new employer.

If the new employer is a registered sponsor but don't have a CoS allocation available it will take some time to get one (and even longer to get a sponsor licence if they are not a registered sponsor at present)

Hi, Thnks for the prompt reply.
Will the current employer be notified from UKBA, of the change of CoS, once the new CoS is assigned to new employer?

and
when does the new visa start from? the starting work date to new employment or earlier depending upon the date of decision made on the new tier-2 application?

many thanks

The current employer will not be notified that another employer has assigned a CoS to you.

The new visa will start from the work start date given in the CoS, or the decision date of the application if that is later, but you are allowed to continue to work in the old employment until the start date of the new employment.

It is safest not to give notice until you have the CoS AND your application has been approved by UKBA.
