Tier 2 ICT queries. Urgent!!!! Pls help

Post by anusiva » Fri Nov 09, 2012 10:18 am

My husband has a Tier2 ICT and is working in UK for 3 years now. His first visa was issued OCT 2009. and extended once last year April 2011. I am currently on Tier2 dependant visa and working here. Our visa will be expiring on 27 nov and we have not applied yet. Its been applied from my husbands company and they have started the process. So there is no chance to get the visa before our expiry date considering the delays applicable.

My query is will that affect my job. Is the application acknowledgement or receipt or whatever we get after the application submission is enough to retain my job until we get our visa? In the worst case if they terminate me will I be able to get another job once our visa is extended?

what do you mean by your husband's company having started the process? What process and when did they start it?

If they have an allocation of T2 ICT CoSs available then they can assign a CoS to your husband immediately, otherwise they have to apply for an increase in their CoS allocation.

when did your husband's employers apply to increase their CoS allocation?

Remind your husband that when he will be in a position to apply for an extension he will have to produce an English certificate to level A1 or above on the CEFR unless one of the exceptions applies (e.g. national of one of the countries listed by UKBA, degree taught in English, etc). If an English certificate is needed he should set this in motion now as time is short.

If an application to extend your husband's and your leave is made before 27 November his and your leave is automatically extended until such time that UKBA make their decision. Your employer may want to see proof that the application has been submitted in order to allow you to continue working beyond 27 November, so keep copy of the application and obtain a certificate of posting.
